APNewsBreak: Judge backs deal on imperiled species (AP)

WASHINGTON ? A federal judge on Friday approved a pair of sweeping settlements that require the government to consider endangered species protections for more than 700 animal and plant species.

The order by U.S. District Judge Emmet Sullivan means the government must act on imperiled species ranging from the northern wolverine and Pacific walrus to dozens of snails, mollusks, butterflies and plants. Some decisions could come by the end of the year and others by 2018.

It comes after the Obama administration reached deals with environmental groups that filed lawsuits challenging the government's handling of more than 250 so-called "candidate species." Those are animals and plants that scientists say are in dire need of protection but that the government has lacked resources to address.

The agreements also cover hundreds of other species for which groups had filed legal petitions seeking protections. The government agreed to address those petitions, although there is no guarantee of new protections.

Some of the species have languished in bureaucratic limbo for decades.

Gary Frazer, assistant director of the U.S. Fish and Wildlife Service, said the affected species all face possible extinction without government intervention.

"These are species that are in trouble," Frazer said. "Once a species has been listed, with a few exceptions, we have kept them from becoming extinct. This is an important step toward conservation of all these critters."

The settlement comes as the government's endangered species program has been under assault on Capitol Hill, where House Republicans submitted a proposed Interior Department budget that have would barred any new listings under the Endangered Species Act. That proposal was defeated in a rare bipartisan vote this summer.

Frazer said current spending levels for the endangered program were sufficient to fulfill Friday's settlement, adding that he was hopeful the agency would have enough money in future years to honor commitments made under the agreements with two environmental groups: Arizona-based Center for Biological Diversity and New Mexico-based WildEarth Guardians.

Some plants and animals covered under the administration's agreements were first proposed for protection soon after the passage of the Endangered Species Act in 1973.

Government officials said the backlog was made worse by lawsuits and legal petitions that distracted wildlife agencies from needed scientific reviews and restoration work. Those legal actions have consumed money and staff time that could be spent on programs such as developing restoration plans for struggling plants and animals, officials said.

The deals signed by WildEarth Guardians and the Center for Biological Diversity require them to limit their future legal actions against the government.

The Safari Club, a hunting group, had attempted to intervene in the case in hopes of derailing the settlement, but Sullivan issued a separate order Friday denying the request. Attorneys for the hunting group said they wanted to preserve the rights of its members to hunt animals covered under the agreements, including greater sage grouse and the New England cottontail rabbit.

SEC suspends destruction of enforcement records (Reuters)

WASHINGTON (Reuters) -The top lawyer at the Securities and Exchange Commission this week ordered the enforcement division to cease destroying all investigative records after an internal whistleblower complained the agency was wrongfully discarding important records.

The order, which was disclosed in a September 7 letter from SEC General Counsel Mark Cahn to the whistleblower's attorney Gary Aguirre, is the latest development in a saga that arose from allegations that the agency has been destroying important investigative files.

The whistleblower, SEC attorney Darcy Flynn, first raised concerns about document destruction in July of last year. At the time, his concerns were focused on documents known as "matters under inquiry," or MUIs, which are preliminary investigative records.

Flynn referred his concerns to the National Archives, which last month issued a statement saying the SEC had destroyed the records without the proper authority, but that it was working with the SEC to prevent future problems and was satisfied the destruction had ceased.

But in a letter sent to SEC Chairman Mary Schapiro and SEC Inspector General David Kotz on September 6, Flynn's attorney raised new concerns that the SEC is still wrongfully destroying records.

This time, however, the allegations extend beyond just preliminary investigative records to include documents from formal probes, such as records pertaining to closed investigations.

In light of this latest complaint, Cahn decided to suspend the destruction of all investigative records until further notice.

"We have been working with (The National Archives and Records Administration) for records retention, and have determined to suspend the current policy out of an abundance of caution until a new policy is in place," SEC spokesman John Nester said.

The issue of the document destruction has recently drawn scrutiny from numerous members of Congress, including Republican Senator Charles Grassley, who sent the SEC a letter last month seeking an explanation.

Kotz is also investigating the destruction of the preliminary investigative records.

It is unclear if he will expand his probe to look into the allegations in the September 6 letter.

The world still thinks Americans are "coolest": poll (Reuters)

LONDON (Reuters) ? They may be witnessing their global superpower influence decline in the face of challenges from other emerging players on the world stage, but Americans have been voted the world's "coolest nationality" in an international poll.

Social networking site Badoo.com (http://www.badoo.com) asked 30,000 people across 15 countries to name the coolest nationality and also found that the Spanish were considered the coolest Europeans, Brazilians the coolest Latin Americans and Belgians the globe's least cool nationality.

"We hear a lot in the media about anti-Americanism," says Lloyd Price, Badoo's Director of Marketing. "But we sometimes forget how many people across the world consider Americans seriously cool."

Of course, not all Americans are cool far from it. Some like Snoop Dogg, Lady Gaga, Samuel L. Jackson, Johnny Depp and Quentin Tarantino are way cooler than others.

Americans, however, are the dudes who invented cool and who still embody it in many fields from music to movies and TV to technology.

"America," says Price, "boasts the world's coolest leader, Obama; the coolest rappers, Jay-Z and Snoop Dogg; and the coolest man in technology, Steve Jobs of Apple, the man who even made geeks cool."

Brazilians are ranked the second coolest nationality in the Badoo poll and the coolest Latin Americans, ahead of Mexicans and Argentinians. The Spanish, in third place, are the coolest Europeans.

The French are voted cooler than the British, and Canadians cooler than the Belgians. This may come as a relief for Canadians, who are sometimes viewed as chronically uncool.

Or, as Michael Ignatieff, the Canadian politician, once put it: "Paris, Texas stands as a metaphor for broken dreams; Paris, Saskatchewan just sounds ridiculous."

Obama approval down amid deep economic fears (Politico)

The debt-limit showdown and the stalled economy have tarnished President Barack Obama?s standing with voters and dampened their optimism about America?s future, with nearly three out of four voters now saying the country is headed in the wrong direction, according to a new POLITICO/George Washington University Battleground Poll.

The dim public outlook is a blunt reminder of why the White House has so much riding on the president?s high-stakes economic speech Thursday and the success of his latest push for a jobs package.

Capturing a rapid erosion of confidence through the summer months, the poll found 72 percent of voters believe the country is either strongly or somewhat headed in the wrong direction, a jump of 12 percentage points since May. Only 20 percent of voters say the country is going in the right direction, a 12-point drop in the same period.

The sudden shift in attitudes reflects the deepening sense in Washington that Obama is increasingly vulnerable as the Republican presidential primary campaign ramps up this month with three debates in the next three weeks.

More Americans disapprove of the way Obama is handling his job, 50 percent, than approve, 45 percent ? a drop of seven percentage points since May. Obama receives particularly low marks for his economic stewardship, with only 39 percent saying they approve and 59 percent saying they disapprove.

And yet, in a seeming contradiction, voters still really like Obama.

Putting aside how they feel about his job performance, 74 percent of voters said they either strongly or somewhat approve of Obama as a person, his highest rating in the past year. His solid personal popularity remains a source of pride ? and hope ? for top advisers who spent 2008 trying to get voters to identify with Obama, an African-American with roots in Hawaii, Indonesia and Chicago.

Mirroring other national polls, Texas Gov. Rick Perry moved to the front of the Republican class, emerging as the first choice for 36 percent of voters only three weeks into his campaign.

Former Massachusetts Gov. Mitt Romney came in second with 17 percent, followed by Rep. Michele Bachmann (R-Minn.) at 10 percent, Rep. Ron Paul (R-Texas) at 10 percent, former Sen. Rick Santorum (R-Pa.) at 5 percent and former House Speaker Newt Gingrich at 5 percent. Businessman Herman Cain and former Utah Gov. Jon Huntsman took 4 percent and 1 percent, respectively.

As former Alaska Gov. Sarah Palin nears a decision on a presidential primary bid, she will need to confront sky-high negative ratings: 61 percent of voters hold either a somewhat or strongly unfavorable view of her. Not even House Minority Leader Nancy Pelosi (D-Calif.), a perennial lightning rod, drew a number that high, at 52 percent.

Among those already in the race, Bachmann is viewed most negatively, with 43 percent who say they have an unfavorable impression of her.

Beltway elites may be pining for more choices in the Republican primary, but a majority of GOP voters, 53 percent, say they are satisfied with the field. Thirty-eight percent said they were unhappy.

The poll offers a mixed bag for Republicans and Democrats as they come off a contentious summer in Washington.
